Without an FIR arrest, no magistrate can be detained without order, Supreme Court

Islamabad:

During the hearing of the Military Courts case in the Supreme Court, Justice Jamal Mandokhel remarked that the arrest could be taken without the registration of the FIR, nor could anyone be detained without the magistrate’s order.

A seven -member constitutional bench, headed by Justice Aminuddin Khan, heard intra -court appeals against the trial in civilian military courts.

Justice Jamal Mandokhel told the Defense Ministry’s lawyer Khwaja Haris to complete his arguments for 20 minutes. Khwaja Haris said that I will try today.

Additional Attorney General Aamir Rehman said that if the arguments of the Defense Ministry’s lawyer were completed today, the Attorney General would give the arguments tomorrow.

Justice Muhammad Ali Mazhar said that the Act also gave some basic rights, Rangers and FC personnel approach the service tribunal against being removed from the job.

Justice Jamal Mandokhel said whether the IG appeals to the police or runs the SP case, an independent forum is also available in India.

The constitutional bench said the chief said that after Khawaja Haris, he would also listen to the Attorney General today. Khwaja Haris said that if the questions of the judges were not high, he would have completed today.

Justice Jamal Mandokhel said, “I assure that no one will ask any questions anymore. Justice Hassan Azhar Rizvi said that you prevented Faisal Siddiqui from taking the name of FB Ali. Now the name of FB Ali is taken every day.
